HBRA, LLC (DBA Pickleball Clubhouse) disclosures, disclaimers, waivers of liability, rules and regulations and codes of conduct collectively referred to as “policies”. Please read carefully.

 

HBRA, LLC DBA Pickleball Clubhouse, its members, managers, lenders, officers, agents, other participants, sponsoring agencies, sponsors, advertisers, owners and lessors, collectively referred to as (“Pickleball Clubhouse”) has collectively adopted policies, designed to provide for the safe, respectful, and healthy use of our premises and events by you, our members, and guests. These policies apply to your conduct on Pickleball Clubhouse’s premises, including its centers, courts, and all outdoor areas, including its parking lots, and sidewalks (“premises”). These policies also apply to your conduct during our events or other Pickleball Clubhouse sponsored activities (“events”).

 

Privacy Policy: By voluntarily submitting your contact information and in communicating with Pickleball Clubhouse through internet, email, text, advertising, and other third-party applications which may collect usage and behavior details, IP address, or other personally identifying information you, the Member or Visitor, acknowledge that Pickleball Clubhouse may send you direct or indirect messages using automated technology to the contact information provided.  You also acknowledge that this information may be used to present our platforms to you or provide you with information about our goods and services.  You acknowledge that are giving your express permission to use this information as well as any further information you may provide on our website or any official or unofficial message boards, chat rooms, etc. (“user contributions”) and hereby release and hold harmless Pickleball Clubhouse from the use of and intentional or accidental dissemination of this information.

 

Accessibility: If you have difficulty using or accessing our website, our facilities or any of our offerings, you may contact us by email, phone or in person at the contact information listed in the footer of our website and we will work to provide you with the information or service seek using an alternate, accessible communication tool consistent with applicable law.

 

Photo & video images consent and release: You acknowledge that photo and video images may be taken while you are using our premises and these may be used, without limitations, in print publications, online publications, websites and on social media.  By agreeing to these policies, you are providing the unconditional right to use the photo and video images and waive any and all rights to royalties or other compensation arising from or related to the use of the photographs taken of you

 

Trademarks: Pickleball Clubhouse™, our logo and any related designs and slogans are trademarks as per the United States Patent and Trademark Office. You may not use any such marks without the prior written permission of Pickleball Clubhouse.

Memberships Rates and Fees: Pickleball Clubhouse is under no obligation to offer anyone membership of any kind and may refuse, suspend or revoke any membership with notice.  Once paid, the membership rate is guaranteed for the duration of the membership period (generally 12 months) only, is not refundable for any reason, and pricing may be changed at the time of renewal or for any new membership. A la carte fees including but not limited to events, programming, tournaments, etc. may be changed at any time with notice for both members and visitors. We may offer discounted membership pricing to, among others, families and youth members, corporate members or anyone else, at our sole discretion.  The general criteria of a family or youth member is someone related by blood or marriage to the primary member, resides in the same location, and in the case of a youth is 14 years of age, or younger.  All membership criteria other than membership fees once paid and only for the duration of the membership period, is subject to change, revision and management approval at any time.

 

Cancellations and Refunds: Membership is annual and pre-paid. You may cancel your membership at any time, but you will not receive a refund of any prior payments. If you do not want to renew your membership, you must cancel no later than 30 days prior to your membership expiration (“cancellation period”).  If you do not cancel during the cancellation period, your membership will automatically renew using the payment method on file at the then current rates. You may cancel a court or other event reservation by going to courtreserve.com.  We will refund all amounts paid if we receive your cancellation notice 48+ hours before your scheduled reservation. We will not refund any amount for a reservation that you fail to attend or fail to reschedule or postpone 48+ hours in advance.

 

Health and Safety: The health and safety of our members and guests is our highest priority. While our policies are designed to help protect you, Pickleball Clubhouse cannot remove all risk or otherwise guarantee or promise that you will not sustain any injuries or damages from viruses, infectious diseases, or other health hazards associated with your use of Pickleball Clubhouse’s premises, facilities, equipment, services, activities, or products (“Use of Pickleball Clubhouse Premises and Services”). On behalf of yourself and your spouse/partner, children/Minor Member(s), and Guest(s), you attest that you are physically and mentally capable of participating in Pickleball Clubhouse activities and have no known health restrictions that might jeopardize your health or safety or the health or safety of others during their participation in Pickleball Clubhouse activities.

 

Assumption of Risk: You understand that there are dangers, hazards, and risks of injury or damage, some of which are inherent, in the use of Pickleball Clubhouse’s premises, facilities, equipment, services, activities, and products. You understand that use of Pickleball Clubhouse’s premises, facilities, equipment, services, activities, or products can include but is not limited to (1) pickleball courts, lobby, entryways, sidewalks, parking lots, and any other facilities; (2) use of services and participation in activities including but not limited to special athletic events; and (3) all other programs, activities, classes, sessions, events, amenities, or benefits that are sponsored, endorsed, or operated by Pickleball Clubhouse on or off its premises.

 

Risks: You understand that the dangers, hazards, and risks of injury or damage in the use of Pickleball Clubhouse Premises and Services (“Risks”) may include but are not limited to (1) slips, trips, collisions, falls, and loss of footing or balance, including “slip and falls”; (2) equipment failure, malfunction, or misuse; (3) property or information theft, misuse, or damage, including from vehicles, equipment, files, or systems; and (4) other accidents or incidents that your result in injury or damage to you, Minor Member(s), or Guest(s).

 

Injuries: You understand that such injuries or damages may include but are not limited to major or minor personal, physical, bodily, emotional, mental, economic, property, or other types of injuries or damages (“injuries”) to you, Minor Member(s), or Guest(s), including but not limited to (1) death; (2) paralysis, brain damage, heart attacks, strokes, disfigurement, heat stress and/or heat stroke, dehydration, concussions, hearing loss, torn, or damaged muscles or ligaments, broken bones, allergic reactions, burns, sprains, bruises, and scrapes; (3) aggravation of pre-existing conditions; (4) pain and suffering; (5) loss of consortium, love, affection, comfort, companionship, or care; (6) emotional distress, embarrassment, humiliation, or shock; (7) lost wages or lost earning capacity; (8) lost, stolen, misused or damaged property or information; and (9) any other disability, impairment, incapacity, injury or damage.

 

You understand that Risks and Injuries in the Use of Pickleball Clubhouse Premises and Services (collectively, “Risks of Injury”) may be caused, in whole or in part, by the NEGLIGENCE OF PICKLEBALL CLUBHOUSE, you, Minor Member(s), Guest(s) and/or other persons. YOU FULLY UNDERSTAND, AND VOLUNTARILY AND WILLINGLY ASSUME, THE RISKS OF INJURY.

 

Waiver of Liability: On behalf of yourself and your spouse/partner, children/Minor Members, Guests, parents, guardians, heirs, next of kin, personal representatives, heirs, and assigns, you hereby voluntarily and forever release and discharge Pickleball Clubhouse from, covenant and agree not to sue Pickleball Clubhouse for, and waive, any claims, demands, actions, causes of action, debts, damages, losses, costs, fees, expenses, or any other alleged liabilities or obligations of any kind of nature, whether known or unknown (collectively, “Claims”) for any injuries to you, Minor Member(s), or Guest(s) in the Use of Pickleball Clubhouse Premises and Services which arise out of, result from, or are caused by any NEGLIGENCE OF PICKLEBALL CLUBHOUSE, you, any Minor Member(s), or Guest(s), and/or any other person (“collectively, “Negligent Claims”).

 

Negligence Claims: You understand that Negligence Claims include but are not limited to Pickleball Clubhouse’s (1) negligent design, construction (including renovation or alteration), repair, maintenance, operation, supervision, monitoring, or provision of the Use of Pickleball Clubhouse Premises and Services; (2) negligent failure to warn of or remove hazardous, unsafe, dangerous, or defective condition; (3) negligent failure to provide or keep premises in a reasonably safe condition; (4) negligent provision of or failure to provide emergency care; (5) negligent hiring, selection, training, instruction, certification, supervision, or retention of employees, independent contractors or volunteers; (6) negligent collection, use, disclosure, or storage of personal, sensitive, or other information (including negligent failure to implement or maintain information security controls); or (7) other negligent act(s) or omission(s).

 

Violations: As a member or guest of Pickleball Clubhouse, you are responsible and expected to always review and comply with these policies. If you violate any of these policies, your membership, facility access, or event participation may be suspended or terminated. Our decision on all questions regarding interpretation or enforcement of these policies is final.

 

Arbitration: In the event a dispute shall arise, it is hereby agreed that any and all disputes shall be referred for arbitration in accordance with United States Arbitration & Mediation Rules of Arbitration. The arbitrator’s decision shall be final and binding and judgment may be entered thereon. In the event a party fails to proceed with arbitration, unsuccessfully challenges the arbitrator’s award, or fails to comply with arbitrator’s award, the other party is entitled of costs of suit including a reasonable attorney’s fee for having to compel arbitration or defend or enforce the award.

 

Defense and Indemnification: On behalf of yourself and your spouse/partner, children/Minor Member(s), Other Member(s), Guest(s), parents, guardians, heirs, next of kin, personal representative, heirs, and assigns, you agree to defend, indemnify, and hold Pickleball Clubhouse harmless to the fullest extent permitted by law from and against any Claim (including any Negligence Claim) asserted against Pickleball Clubhouse by any other person (including but not limited to any Other Member, any Guest, and other Pickleball Clubhouse member, or guest, any family member who is not a Pickleball Clubhouse member, or any other person or entity) arising out of, resulting from, or caused by the Use of Pickleball Clubhouse Premises and Services by you, your Minor Member(s), your Other Member(s), or your Guest(s). Your agreement to defend Pickleball Clubhouse means that you will pay any settlement, judgment, or other damages, fees, or costs of any type incurred by Pickleball Clubhouse to resolve the claim.

 

 

Code of Conduct:

Respect: You agree to treat all other members, visitors, staff and our facility with courtesy at all times.  Conflicts on and off the court will be resolved respectfully.

Etiquette: You agree to wear and use activity appropriate attire and equipment, not to interrupt the play of others and endeavor to understand the rules of the game, help others to do so and be a person of integrity.

Safety: You agree to use good judgement about safe and unsafe behavior, bring any safety concerns to the attention of the staff.

Community: The Pickleball Clubhouse is a community and none are more welcome here than others.  Be an ambassador of our great sport and welcome any and all.

These are guidelines for your conduct.  Any violations or refusal to respect these guidelines, in the sole discretion of management, may result in suspension or termination of your membership and/or access to Pickleball Clubhouse.

 

By submitting this information to Pickleball Clubhouse, and/or paying for membership and/or other Guest use, and/or entering the premises for any reason, you unconditionally agree to these policies.  You acknowledge that you have been given the opportunity and encouraged to seek independent legal advice prior to signing this Agreement.

 

We may change any or all of these policies at any time without notice, in our sole discretion. As a member or guest of Pickleball Clubhouse, you are responsible for and expected to review and comply with the most recent version of these policies. By agreeing to these policies now, you are also agreeing to re-read and be bound by the most updated version of these policies which can be found at www.pickleballclub.house/policies, before each visit to the premises.​​​​
